Terms of Service

Agreement

These Terms of Service ("Terms") are a legal agreement between you and Updraft Technologies FZ-LLC ("Updraft", "we", "our", "us"), a company registered in Ras Al Khaimah, United Arab Emirates. By downloading, installing, or using the Updraft iOS app ("the app") or our website, you agree to be bound by these Terms. If you do not agree, do not use our services.

Eligibility

You must be at least 13 years old to use Updraft. By using the app, you represent that you meet this age requirement.

Subscriptions & Purchases

Updraft offers optional premium subscriptions and a one-time lifetime purchase through Apple's In-App Purchase system:

• Monthly subscription — billed monthly and automatically renews each month.
• Annual subscription — billed yearly and automatically renews each year.
• Lifetime — a one-time purchase with no recurring charges.

Auto-Renewal

Monthly and annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time by going to Settings > [your name] > Subscriptions on your iOS device.

Price Changes

We may change subscription pricing from time to time. Apple will notify you of any price increase and, where required, ask for your consent before the new price takes effect.

Free Trials

If a free trial is offered, it begins when you start your subscription. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the then-current price. Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds

All payments are processed by Apple. We do not process refunds directly. To request a refund, follow Apple's refund process at reportaproblem.apple.com. All refunds are subject to Apple's policies.

Use of the App

Updraft is a fitness tracking tool for personal use. You are responsible for the data you enter and for maintaining access to your device. You agree not to use the app for any unlawful or unauthorized purpose.

Health Disclaimer

Updraft is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your health or training, and before starting any new exercise program. Do not disregard professional medical advice or delay seeking it because of information presented in the app.

Intellectual Property

The app, including all content, design, code, graphics, and trademarks, is owned by Updraft Technologies FZ-LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the app without our express written permission.

Third-Party Services

The app may integrate with third-party services such as Apple HealthKit. Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Availability

We aim to keep the app available and functioning, but we do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time without prior notice. We are not liable for any loss or inconvenience caused by downtime or feature changes.

Limitation of Liability

To the fullest extent permitted by applicable law, Updraft is provided "as is" without warranties of any kind, either express or implied. Updraft Technologies FZ-LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or any other damages arising from or in connection with your use of or inability to use the app, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Apple's Role

You acknowledge that these Terms are between you and Updraft, not Apple Inc. ("Apple"). Apple is not responsible for the app or its content. Apple has no obligation to furnish any maintenance or support services with respect to the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, UAE.

Changes

We may update these Terms from time to time. If we make material changes, we will notify you within the app or via email. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

Termination

We may suspend or terminate your access to the app at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the app ceases immediately. The provisions of these Terms that by their nature should survive termination shall do so.
